I suggest that github adds excptions to the age limit for some places or removes the age limit or allow support to override the age limit |

The core reason GitHub can't simply carve out exceptions by jurisdiction is COPPA — the US federal Children's Online Privacy Protection Act. Because GitHub is a US company with US servers, it has to comply with COPPA for any user who might be under 13, regardless of where that user is physically located. BC not having an equivalent minimum age law doesn't change GitHub's obligations under US federal law. On the "it breaks BC law" point: BC law not requiring a minimum age is different from BC law prohibiting one. A US company applying a stricter standard than BC law requires isn't breaking BC law, it's just being more restrictive than BC requires. Those are very different things legally. The suggestion to add jurisdiction-specific exceptions is understandable, but practically it creates a compliance nightmare for GitHub: they'd need to verify a user's actual location (not just their claimed location), track which laws apply in each province/country, and update the logic as laws change. The 13+ global floor is a much simpler and legally safer policy to maintain. |
