Nirvana has won a court ruling dismissing a lawsuit filed by the man who appeared as a nude baby on the cover of the band's 1991 album 'Nevermind.' Now in his 30s, Spencer Elden claimed the photo — one of the most iconic album covers in rock history — violated federal child pornography laws by displaying a sexualized image of a minor. But a federal judge ruled plainly on Tuesday that it was "not child pornography" — saying the famed image did not even come close to meeting the definition of such illegal content under federal law. Chen ruled that Martin Shkreli had potentially violated federal protections for trade secrets by retaining copies of the ultra-rare rap album after he forfeited it to prosecutors as restitution after he was convicted of securities fraud. President Donald Trump has signed an executive order that he says will allow TikTok to continue operating in the United States in a way that meets national security concerns laid out by the law. President Joe Biden signed legislation last year calling for China’s ByteDance to sell TikTok’s assets to an American company by early this year or face a nationwide ban, but Trump has repeatedly signed orders that have allowed TikTok to keep operating in the U.S. as his administration tries to reach an agreement for the sale of the social media company.
