📢 Government Shutdown Update: Impact on E-Verify As of October 1, 2025, the U.S. federal government has shut down. One of the affected services is E-Verify, which is now temporarily unavailable. Since Fountain’s I-9 Center integrates with E-Verify, here’s what you need to know: ✅ Form I-9s are still required. Employers must complete I-9s within three business days of a new hire’s start date. This rule has not changed. ⛔ E-Verify is offline. You cannot create new cases, update existing ones, or act on Tentative Nonconfirmations (TNCs) until the system is restored. 📝 If a case ends up late: Once E-Verify is back online, select “Other” as the reason and type “Federal Government Shutdown.” This ensures delays are properly documented for audits. ⏸ TNC deadlines are paused. Any cases already in TNC status will have extended deadlines until the system is available again. 🔒 Other Fountain products are not impacted. E-Verify Temporarily Unavailable 🚨 As of October 1, 2025, the Department of Homeland Security (DHS) has suspended all E-Verify services due to a lapse in federal funding. Until Congress passes an appropriations bill, employers will not be able to: Enroll in E-Verify Create new cases or update existing ones Reset passwords or edit user information Access Self Check or Self Lock (myE-Verify) Receive customer support by phone or email What this means for employers 1.Form I-9 is still required: Employers must continue to complete and retain Form I-9 for all new hires within three business days. 2.Three-day rule suspended: The requirement to create an E-Verify case within three days of hire is on hold. Employers should document the delay as “Technical Problems” once the system is available again. 3.No adverse action: Employers cannot terminate or take action against employees because their employment eligibility cannot be confirmed while E-Verify is offline. 4.Tentative Nonconfirmations (TNCs): If an employee is disputing a TNC, cases must remain on hold until E-Verify resumes. Employees will have additional time to resolve issues once the system is back online. 5.Remote verification: Employers already using the alternative remote procedure may continue to do so, with the understanding that cases must eventually be submitted to E-Verify. The key takeaway is that I-9 compliance remains mandatory, but E-Verify requirements are paused until the system is restored. Employers should be ready to process pending cases once services are back up.
