Mexico's water reform didn't just tighten permitting — it created individual criminal liability for the first time. The December 2025 reform to Mexico's water law, followed by the National Water Program published in May 2026, eliminates private transfers of water concessions, puts a strict two-year clock on unused volumes, and criminalizes conduct like tampering with measurement equipment — with penalties reaching up to 9 years in prison for the individuals involved, not fines for the company. CONAGUA itself acknowledges a backlog of roughly 150,000 pending water permits. If your company has a transfer, extension, or modification request stuck in that system, you're not alone — but you may be operating under a title the government hasn't finished processing, in an environment where oversight is about to tighten. Multinationals with dedicated compliance teams are already tracking this. Mid-sized operators — plants, bottling facilities, agribusiness, hospitality — typically aren't, and they're the ones with the least room to react once enforcement increases. EmpCo Directive: Good intentions, difficult reality? The transposition of the EmpCo Directive into national law is creating major challenges for businesses across Europe. In Germany, the agreed transitional approach offers little comfort. Because the rules are being implemented through unfair competition law (UWG), competitors and consumer associations will be able to take legal action against problematic environmental claims from day one.
