Welcome to Kimi! Kimi products and services are provided by Beijing Moonshot Technology Co., Ltd. and its affiliates ("Moonshot AI," "we," "us," or "our") through websites, applications, browser extensions, mini-programs, and other innovative forms of delivery, including but not limited to the platform with generative artificial intelligence services as its core function ("Kimi" or "the Service").
This Agreement sets forth the terms under which we provide the Service to you. In addition to this Agreement, specific modules may be subject to separate agreements or product rules ("Specific Agreements"), including the Kimi Privacy Policy and the Kimi Paid Services Agreement. Specific Agreements supplement this Agreement and form an integral and indivisible part thereof with equal legal effect. Where a Specific Agreement conflicts with this Agreement, the Specific Agreement shall prevail. For example, the platform provides users with services including but not limited to free basic services and paid value-added services; when using paid value-added services, you shall, in addition to this Agreement, also comply with the Kimi Paid Services Agreement and relevant announcements.
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SERVICE. PROVISIONS RELATING TO THE LIMITATION OR EXCLUSION OF OUR LIABILITY AND THE LIMITATION OF YOUR RIGHTS ARE HIGHLIGHTED IN BOLD. PLEASE REVIEW THEM CAREFULLY.
IF YOU ARE UNDER 18 YEARS OF AGE, PLEASE READ THIS AGREEMENT WITH YOUR LEGAL GUARDIAN AND OBTAIN THEIR CONSENT BEFORE USING THE SERVICE.
BY CLICKING "AGREE" OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
1. Service Description
1.1 The Service
We provide AI services powered by large language models. The model generates content in response ("Output" or "Generated Content") based on user input ("Input"). Input and Output are collectively referred to as "Content."
1.2 Service Recipients
The Service is primarily intended for adults with full civil capacity. Due to the characteristics of the Service, users are required to effectively identify and reasonably apply Content. IF YOU ARE A MINOR OR LACK THE CIVIL CAPACITY TO USE THE SERVICE, YOU MAY USE THE SERVICE ONLY WITH THE CONSENT AND SUPERVISION OF YOUR LEGAL GUARDIAN.
1.3 Permitted Use Cases
The Service is for personal learning, research, appreciation, daily life, and entertainment.
1.4 Risk Notice
AI and machine learning are rapidly evolving research fields. We have been striving to improve the Service to make it more accurate, reliable, secure, and beneficial. However, given the uncertainty and probabilistic nature of machine learning, We strive to improve the Service, but given the probabilistic nature of machine learning, the Service may produce inaccurate results. We cannot guarantee the accuracy, completeness, or timeliness of the Output. In addition, due to technical limitations, the Output may not exhaustively display the content you want.
When using the Service:
(a) Do not treat the Output as the sole source of facts or as absolutely true information. You need to independently evaluate the accuracy and applicability of Content, and reasonably apply or share it according to your purpose and scenario, so as to avoid adverse effects caused by erroneous or inappropriate content;
(b) The Output is not a substitute for professional advice in medicine, law, finance, education, or other regulated fields.
(c) Do not directly use Generated Content to make decisions that may have legal or other material impact on individuals, such as decisions concerning an individual’s credit, education, employment, housing, insurance, legal matters, medical treatment, or other major decisions;
(d) The Output does not represent Moonshot AI's views. Any mention of any third-party product or service in the Output does not imply that such third party endorses the content or is affiliated with Moonshot AI. If you use the web search function, we retrieve publicly available third-party information to assist with your Input. The search sources will be displayed in the search bar on the right side of the page. All search sources are produced and provided by third parties; the Output of the Service may be the model’s integration of information from such search sources, which is for your reference only and does not mean that the Service approves of or agrees with any position or view of the linked webpage content, or endorses the truthfulness, accuracy, or reliability of such content.
2. Account Usage
2.1 Registration
You may register via mobile phone number or third-party accounts. You must provide true, accurate, and valid information, keep such information updated in a timely manner, and confirm your agreement to this Agreement and other related rules and policies. Third-party accounts must be real-name verified. You shall not register an unreasonable number of accounts. If you choose to refuse to provide identity information, or the information you provide is inaccurate, untrue, or non-standard, or we have reason to suspect that the information is erroneous, untrue, or unlawful, you may be unable to use the Service or certain functions may be restricted during use.
2.2 Use and Transfer
Upon successful registration, you have the legal right to use your account and shall bear legal responsibility for all activities under your account. If you purchase Paid Services, you shall ensure the legality of your payment account and payment method. YOU MUST KEEP YOUR ACCOUNT PROPERLY SAFEGUARDED AND MUST NOT, WITHOUT AUTHORIZATION, SHARE YOUR ACCOUNT CREDENTIALS OR MAKE YOUR ACCOUNT AVAILABLE TO OTHERS. You shall be responsible for any losses caused by your failure to safeguard your account, including theft or illegal use of your account.
2.3 Cancellation
You may cancel your account at any time. HOWEVER, ONCE CANCELLED, YOUR ACCOUNT DATA AND PAID RIGHTS ARE NOT RECOVERABLE. Please cancel your account with caution. After cancellation, we will still retain your corresponding registration data, behavior records, and other log information as required by laws and regulations such as the Cybersecurity Law. If you violated this Agreement before cancellation, we retain the right to enforce our rights.
2.4 Remedies
If you lose your account or leak your verification code, you may contact us promptly to request recovery. If you discover any illegal use of a user account, please contact us immediately, and we will cooperate and handle it as soon as possible.
3. Rights and Obligations
3.1 Your Rights and Obligations
You have the right to use the Service in accordance with this Agreement and to provide feedback and file complaints. You must comply with applicable laws, this Agreement, and other related agreements, rules, and policies published by us on the Service-related pages. You must not use the Service for illegal activities or conduct that endangers national security, public interests, or infringes on others' lawful rights and interests, or disrupts the platform's operating order. You may not transfer any rights or obligations under this clause, and any such attempt shall be invalid.
3.2 Our Rights and Obligations
We will provide services in accordance with laws and regulations, actively perform our statutory duties, protect network security, data security, and your personal information, protect minors' lawful interests and physical and mental health, endeavor to maintain the secure, stable, and continuous operation of the Service with existing technologies, and strive to upgrade and improve our technologies to safeguard your service experience. However, due to technical and resource limitations, we cannot guarantee timely response to all requests, and we ask for your understanding.
IF YOU VIOLATE APPLICABLE LAWS, THIS AGREEMENT, OR PLATFORM RULES, WE MAY, WITHOUT NOTICE: (A) REQUIRE YOU TO RECTIFY; (B) BLOCK OR DELETE YOUR CONTENT; (C) SUSPEND OR REVOKE YOUR RIGHTS (INCLUDING PAID RIGHTS); (D) FREEZE, CLOSE, OR TRANSFER YOUR ACCOUNT; (E) REFUSE, SUSPEND, OR STOP PROVIDING SERVICES.
4. User Code of Conduct
4.1 When registering and using your account, you must:
(a) Bear full responsibility for the authenticity, legality, and validity of your registration and payment information; do not include illegal or harmful information in your account name, avatar, bio, or other registration or personal information; update your registration information in a timely manner; and do not register an account or use the Service by impersonating others (including but not limited to using another person’s name, title, trade name, avatar, or any other means sufficient to cause confusion);
(b) Safeguard your account and bear responsibility for all activities under it;
(c) Not register accounts maliciously, including frequent or bulk registration;
(d) Not transfer, lend, lease, or provide your account to others;
(e) Not use payment channels that are not officially recognized or are illegal to make payments, and not use the Service in a fraudulent or otherwise dishonest manner;
(f) Not engage in other illegal or unreasonable registration or use of the Service.
4.2 When submitting Input, you must:
(a) Ensure it does not contain state secrets or data affecting national security or public interests, and does not infringe any person's intellectual property rights, portrait rights, reputation rights, honor rights, name rights, privacy, personal information rights and interests, or other lawful rights and interests;
(b) For personal information, obtain informed consent (or separate consent for sensitive information), or apply anonymization measures that comply with legal requirements; otherwise, please do not upload such information to the platform; Do not submit sensitive personal information of minors under 14.
(c) For commercial information (especially trade secrets), ensure you have the right to process it and apply necessary desensitization before upload.
4.3 You must not use the Service for illegal or improper purposes:
(a) Purposes that may cause serious harm to human health, psychology, society, or economics, or that violate technology ethics.
(b) Infringing intellectual property rights, trade secrets, or business ethics.
(c) Using algorithms, data, or platform advantages for monopolistic or unfair competition.
(d) Fraud, deception, or misleading activities.
(e) Infringing privacy or lawful personal information rights and interests, such as illegally collecting or disclosing personally identifiable information or educational, financial, or other protected records, including but not limited to addresses, telephone numbers, email addresses, numbers and features contained in personal identity documents (such as ID card numbers, social security account numbers, and passport numbers), or credit card numbers;
(f) Other uses prohibited by law or that may harm public interests or our or third-party rights.
4.4 You must not use the Service to create or publish illegal content:
(a) Content opposing the basic principles of the Constitution.
(b) Content endangering national security, leaking state secrets, subverting state power, or undermining national unity.
(c) Content damaging national honor or interests.
(d) Content that distorts, disparages, desecrates, or denies the deeds and spirit of heroes and martyrs, or infringes upon the names, portraits, reputation, or honor of heroes and martyrs by insult, defamation, or other means;
(e) Content promoting terrorism or extremism.
(f) Content inciting ethnic hatred, discrimination, or undermining ethnic unity.
(g) Content undermining national religious policies or promoting cults.
(h) Content spreading rumors or disrupting social or economic order.
(i) Content that is obscene, pornographic, gambling-related, violent, murderous, terrorist, or crime-inciting content;
(j) Content insulting, defaming, or infringing on others' rights.
(k) Other content prohibited by applicable law.
4.5 You must not create or publish harmful content:
(a) Exaggerated titles seriously mismatched with content.
(b) Gossip, scandals, or misdeeds.
(c) Improper comments on natural disasters or major accidents.
(d) Sexual innuendo or provocation.
(e) Blood, horror, cruelty, or content causing physical or mental discomfort.
(f) Inciting discrimination against groups or regions.
(g) Vulgar, philistine, or kitsch content.
(h) Content that may induce minors to imitate unsafe behaviors or behaviors violating social morality, or induce minors to develop bad habits;
(i) Other content adversely affecting the online ecosystem.
4.6 You must not engage in activities endangering network security or operational order:
(a) Activities that endanger network security, such as illegally intruding into networks, interfering with normal network functions, or stealing network data, for example: using unauthorized data or accessing unauthorized servers/accounts; forging TCP/IP packet names or partial names; attempting, without permission, to probe, scan, or test weaknesses of the Service’s system or network or otherwise sabotaging network security; entering networks or computer systems without permission to delete, modify, or add stored information; attempting to interfere with or disrupt the normal operation of the Service’s system or website, deliberately spreading malicious programs or viruses, or otherwise disrupting normal network information services;
(b) Providing programs or tools specifically used for activities that endanger network security, such as intruding into networks, interfering with normal network functions and protective measures, or stealing network data;
(c) Knowingly providing technical support, advertising and promotion, payment settlement, or other assistance to others who engage in activities endangering network security;
(d) Reverse engineering, reverse assembling, reverse compiling, translating, or otherwise attempting to discover the source code of the Service, its models, algorithms, or the source code or underlying components of its systems;
(e) Writing or using any automated scripts, programs, or tools (including but not limited to bots, crawlers, scheduled tasks, etc.) to simulate manual operations, so as to achieve automated or bulk use of our products or services;
(f) Repeatedly and massively performing identical or similar operations, or submitting identical or similar content at high frequency, thereby disrupting the normal operation and order of the Service;
(g) Without our authorization, using the Service to develop or serve applications, products, services, or models that may compete with the Service;
(h) Without our authorization, copying, transferring, renting, lending, selling, or sub-licensing all or part of the Service;
(i) Using the Service beyond the licensed scope or engaging in any other potential abuse of the Service;
(j) Other conduct endangering network security or operational order.
4.7 You must not circumvent security mechanisms:
(a) Malicious circumvention, including but not limited to using variants, garbled text, characters, homophones, or other means to evade Service detection so as to input or generate illegal speech;
(b) Malicious attacks, inducement, and poisoning by means such as identity impersonation, reverse induction, or jailbreak attacks;
(c) Deleting, tampering with, or concealing the AI-generated content identifiers we have added (including prominent identifiers visible to the naked eye on Generated Content and hidden identifiers embedded in the metadata files of Generated Content through specific technical means), or engaging in other acts in violation of_the Measures for the Identification of Artificial Intelligence-Generated Synthetic Content_;
(d) Other conduct maliciously circumventing security management.
5. Intellectual Property and Other Rights
5.1 Except for the relevant rights holders who are entitled to rights in accordance with the law, Moonshot AI owns all rights (including but not limited to intellectual property rights such as copyrights, trademark rights, and patent rights, and other rights) in the Service to the extent permitted by laws and regulations.
5.2 On the premise of not infringing others' lawful intellectual property rights or other rights and complying with this Agreement, and to the extent permitted by law, 5.2 you own the intellectual property rights and other rights in your Input and Output, and bear the obligation to be responsible for the Content. Due to technical limitations, we cannot guarantee that other users’ content is completely different from yours, and the occurrence of similar Output cannot be ruled out; accordingly, Your rights over the Output do not extend to other users' content.
5.3 TO IMPROVE THE SERVICE, YOU GRANT US A FREE LICENSE TO USE YOUR INPUT, OUTPUT, AND FEEDBACK FOR MODEL OPTIMIZATION WITHIN THE SCOPE PERMITTED BY LAW. IF YOU DO NOT WISH YOUR CONTENT TO BE USED FOR MODEL TRAINING, PLEASE CONTACT US THROUGH THE CONTACT INFORMATION PROVIDED IN THIS AGREEMENT.
6. AI-Generated Content Identification Rules
To improve transparency in AI processing, protect the public's right to know, and support content traceability, we identify Generated Content such as text, images, audio, and video generated through artificial intelligence technology in accordance with the Measures for the Identification of Artificial Intelligence-Generated Synthetic Content and relevant national standards.
6.1 Definitions
(a) Generated Content: Content generated or significantly modified by AI, including text, images, audio, and video.
(b) Explicit Identifier: Text, sound, or graphic prompts (such as watermarks or page prompt banners) directly perceivable by users.
(c) Implicit Identifier: Technical markers embedded in file metadata that can be used for traceability and regulatory oversight.
6.2 Default Identification
UNLESS YOU USE FUNCTIONS WE PROVIDE OR ARE APPROVED TO REMOVE EXPLICIT IDENTIFIERS, WE DEFAULT TO ADDING BOTH EXPLICIT AND IMPLICIT IDENTIFIERS TO ALL GENERATED CONTENT.
Explicit Identifiers: An "AI-Generated" identifier is displayed prominently in the interface, on generated images, or in other applicable positions.
Implicit Identifiers: WE EMBED IMPLICIT IDENTIFIERS IN ALL GENERATED CONTENT IN ACCORDANCE WITH NATIONAL STANDARDS. They do not affect normal use.
6.3 Your Identification Obligations
YOU MUST NOT REMOVE, OBSCURE, ALTER, HIDE, OR CIRCUMVENT ANY EXPLICIT OR IMPLICIT IDENTIFIERS ADDED BY THE SERVICE. DOING SO MAY RESULT IN LEGAL LIABILITY.
You must not use de-identified Generated Content for illegal purposes or to infringe on others' rights. Any third-party complaints, claims, or lawsuits arising from your use or dissemination of de-identified Generated Content shall be borne solely and independently by you. IF YOUR CONDUCT CAUSES US TO SUFFER PENALTIES OR LOSSES, YOU SHALL COMPENSATE US FOR ALL LOSSES AND REASONABLE EXPENSES.
The identifier does not constitute our guarantee or endorsement of the content's authenticity, accuracy, ownership, or applicability.
7. Anthropomorphic Interactive Services
7.1 The Service may be provided to you in anthropomorphic interactive forms. Please be aware and understand that such services are powered by artificial intelligence models. The party interacting with you is not a natural person, and the Output is generated by artificial intelligence. The Output does not represent the expression of intent of any real individual, nor does it constitute any professional opinion or advice.
7.2 To implement the management requirements of relevant laws and regulations on anthropomorphic interactive services and to protect users' physical and mental health and lawful rights and interests, we may, based on laws and regulations, regulatory requirements, and operational needs, adopt one or more usage management measures for anthropomorphic interactive services, including but not limited to reminders or management of usage duration, over-reliance warnings, feature or Content restrictions, and spending restrictions. The specific form, trigger conditions, scope of application, and implementation time of such measures shall be subject to product page displays, system prompts, or rules separately published by us. Unless otherwise provided by laws and regulations, we may adjust such measures and their implementation standards in response to changes in laws and regulations, regulatory requirements, or actual technical and management conditions.
7.3 When using anthropomorphic interactive services, you understand and agree to comply with the foregoing usage management measures and related prompts, arrange your usage time reasonably, view and use anthropomorphic interactive Content rationally, and not use anthropomorphic interactive services to engage in activities prohibited by laws and regulations or this Agreement, or circumvent, damage, or interfere with the normal operation of the foregoing usage management measures.
7.4 To better protect minors' physical and mental health and lawful rights and interests, we may further restrict the anthropomorphic interactive Content available to minors in accordance with laws and regulations. If you are a minor, you should use the relevant services under the guidance and supervision of your guardian and comply with all restrictions under Minors Mode.
8. Liability for Breach
8.1 You understand and agree that, for your violations of this Agreement and relevant laws and regulations, we may make independent judgments, including comprehensive determinations based on your information, behavior data, or other interactive relationships, and, without notice, take measures including but not limited to: warnings; rectification requirements; feature restrictions; rights or quota suspension or termination (including cancellation of paid rights without compensation); suspension of use, account closure, prohibition of re-registration, content deletion. We have the right to announce the enforcement results and to decide, based on actual circumstances, whether to restore use.
8.2 YOU SHALL INDEPENDENTLY BEAR ALL LEGAL LIABILITIES AND THIRD-PARTY CLAIMS ARISING FROM YOUR BREACH. IF THIS CAUSES LOSS TO US, YOU SHALL COMPENSATE US IN FULL, INCLUDING LITIGATION FEES, ARBITRATION FEES, ATTORNEY FEES, NOTARIZATION FEES, APPRAISAL FEES, TRAVEL EXPENSES, INVESTIGATION COSTS, COMPENSATION, LIQUIDATED DAMAGES, SETTLEMENT FEES, AND ADMINISTRATIVE PENALTY FINES.
9. Limitation of Liability
9.1 Third-Party Services
The Service may incorporate or interact with third-party content, products, tools, or services ("Third-Party Services"), including plug-ins, APIs, external platforms, authentication providers, payment processors, or links to external websites or content. WITH RESPECT TO THIRD-PARTY SERVICES:
(a) WE DO NOT ENDORSE OR ASSUME RESPONSIBILITY FOR ANY THIRD-PARTY SERVICES.
(b) WE MAKE NO WARRANTIES REGARDING THE AVAILABILITY, FUNCTIONALITY, ACCURACY, SECURITY, LEGALITY, OR ANY OTHER ASPECT OF THIRD-PARTY SERVICES. USE IS AT YOUR SOLE DISCRETION AND RISK.
(c) TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF OR RELIANCE ON THIRD-PARTY SERVICES, INCLUDING BUT NOT LIMITED TO ANY SERVICE FAILURE, DATA BREACH, INACCURATE INFORMATION, OR THIRD-PARTY MISCONDUCT.
(d) You are solely responsible for reviewing and complying with applicable third-party terms, conditions, privacy policies, or other agreements.
(e) Your use of Third-Party Services may be subject to additional fees, costs, terms, or restrictions imposed by those third parties.
9.2 Force Majeure
We assume no liability for performance obstacles, defects, delays, or changes caused by:
(1) force majeure (natural disasters, strikes, riots, wars, government actions, or judicial or administrative orders);
(2) public service failures (power, communications) or third-party factors (such as viruses in mobile communication terminals, hacker attacks, or system instability);
(3) with due care and good-faith management having been exercised, routine or emergency equipment and system maintenance, equipment and system failures, or network information and data security factors.
9.3 Technical Limitations
UNLESS OTHERWISE PROVIDED BY LAW, WE MAKE NO WARRANTIES THAT:
THE SERVICE WILL MEET YOUR SPECIFIC NEEDS;
THE SERVICE WILL BE ACCURATE, RELIABLE, FUNCTIONALLY AVAILABLE, TIMELY, ERROR-FREE, UNINTERRUPTED, OR CONTINUOUSLY STABLE, AND FREE FROM ANY FAULTS;
ALL INFORMATION WILL BE FLAWLESS, UNBIASED, NON-INFRINGING, OR ENTIRELY REASONABLE;
CODE, PROGRAMS, OR REFERENCED CONTENT WILL BE ACCURATE, STABLE, OR COMPLETE;
OUTPUT FROM MALICIOUS INDUCEMENT WILL BE CONSISTENT WITH OUR VIEWS.
9.4 If you encounter information related to borrowing, investment, financing, wealth management, or other property-related matters, as well as account credentials or advertisements, please stay vigilant and exercise your own judgment. Unless otherwise provided by laws and regulations, we assume no responsibility for any judgment you make based on such information.
9.5 UNLESS EXPRESSLY PROVIDED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REPUTATIONAL DAMAGE, OR DATA LOSS. OUR TOTAL DIRECT LIABILITY SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US DURING YOUR USE OF THE SERVICE (IF ANY).
9.6 We may process illegal content per this Agreement, but this does not constitute our obligation. We cannot guarantee detection of all illegal acts.
9.7 WE RESERVE THE RIGHT TO TRANSFER RIGHTS OR OBLIGATIONS UNDER THIS AGREEMENT TO ANY AFFILIATE, SUBSIDIARY, OR BUSINESS SUCCESSOR.
10. Termination of Service
10.1 You may terminate the Service at any time via the cancellation process. If you violate laws and regulations, this Agreement, or platform rules, or infringe upon the lawful rights and interests of the public, us, or third parties, we may terminate the Service depending on the circumstances.
10.2 FOR THE NEEDS OF OVERALL SERVICE OPERATION, WE RESERVE THE RIGHT TO DETERMINE THE SERVICE/FUNCTION SETTINGS AND SCOPE BASED ON ACTUAL CIRCUMSTANCES, AND TO MODIFY, INTERRUPT, SUSPEND, OR TERMINATE THE SERVICE.
10.3 IF TERMINATION IS DUE TO YOUR REASONS, YOUR ACCOUNT RIGHTS AND INTERESTS WILL TERMINATE WITHOUT COMPENSATION. IF TERMINATION IS DUE TO OUR REASONS AND YOU HAVE UNEXPIRED PAID RIGHTS, WE WILL COMPENSATE YOU IN ACCORDANCE WITH THE PRINCIPLE OF FAIRNESS.
11. Minors Usage Notice
11.1 Minors should use the Service under the supervision and guidance of their guardians, learn to use the Internet properly and correctly within a reasonable scope, avoid addiction to virtual cyberspace, and develop healthy online habits.
11.2 Minor users shall abide by the National Youth Network Civilization Convention:
Be good at learning online; do not browse harmful information.
Be honest and friendly in communication; do not insult or deceive others.
Enhance self-protection awareness; do not casually meet online friends.
Safeguard network security; do not disrupt network order.
Be beneficial to physical and mental health; do not indulge in virtual time and space.
11.3 TO PROTECT MINORS' PRIVACY, PLEASE STRICTLY ABIDE BY RELEVANT LAWS AND CAREFULLY UPLOAD CONTENT CONTAINING MINOR INFORMATION. ONCE UPLOADED, IT IS DEEMED THAT YOU AGREE THAT WE MAY PROCESS CONTENT RELATED TO THE MINOR IN THE SERVICE IN ACCORDANCE WITH THE LAW AND THIS AGREEMENT.
11.4 We provide a "Minors Mode" for minors. Guardians must accompany minors in reading this Agreement and obtain consent. The minor or guardian shall enable Minors Mode. Minor users shall provide necessary information such as age, guardian, or emergency contact, which is used to identify the minor’s identity and provide corresponding protection. To better protect minors’ lawful rights and interests and physical and mental health, Minors Mode may undergo iterations and interface updates as required by laws, regulations, and technological updates, including but not limited to appropriate restrictions on certain functions and additional filtering of output content. The specific functions, scope of restrictions, and usage methods of Minors Mode shall be subject to the display on the product page or the usage instructions we separately publish.
12. Governing Law and Dispute Resolution
12.1 This Agreement shall be governed by the laws of the People's Republic of China (Mainland).
12.2 IF A DISPUTE ARISES, BOTH PARTIES SHALL ENDEAVOR TO RESOLVE IT THROUGH FRIENDLY NEGOTIATION. IF NEGOTIATION FAILS, EITHER PARTY MAY FILE A LAWSUIT WITH THE COURT HAVING JURISDICTION AT THE DOMICILE OF BEIJING MOONSHOT TECHNOLOGY CO., LTD.
13. Miscellaneous
13.1 Severability
IF ANY PROVISION IS INVALID OR UNENFORCEABLE, IT SHALL BE SEVERABLE AND SHALL NOT AFFECT THE VALIDITY OF OTHER PROVISIONS. OUR DELAY IN EXERCISING ANY RIGHT DOES NOT CONSTITUTE A WAIVER.
13.2 Updates
TO CONTINUOUSLY OPTIMIZE THE SERVICE EXPERIENCE AND ADAPT TO CHANGES IN NATIONAL LAWS AND REGULATIONS, POLICIES, TECHNICAL CONDITIONS, AND PRODUCT FUNCTIONS, WE MAY UPDATE THIS AGREEMENT FROM TIME TO TIME.THE UPDATED CONTENT WILL FORM AN INTEGRAL PART OF THIS AGREEMENT AND WILL BE NOTIFIED TO YOU THROUGH PAGE PUBLICATION, PAGE PROMPTS, INFORMATION PUSH, OR OTHER MEANS. IF YOU CONTINUE TO USE THE SERVICE, YOU AGREE TO THE UPDATED CONTENT.IF YOU OBJECT TO THE UPDATED TERMS, YOU HAVE THE RIGHT TO STOP LOGGING IN TO OR USING THE SERVICE.
13.3 Subheadings
Subheadings are for convenience only and do not affect interpretation.
13.4 Language
This Agreement is executed in both Chinese and English. Both language versions shall have equal legal effect. In case of any discrepancy, ambiguity or conflict between the two language versions, the Chinese version shall prevail.
