This is a good move, and the nuance matters. Germany has rejected accessibility overlays as a valid path to European Accessibility Act (EAA) compliance. To be clear: overlays don’t send users to a separate or “lesser” version of a site. Users are still on the primary experience. That’s the whole point of an overlay. The problem is how overlays work. On the widget side, you get UI tools that often conflict with assistive tech people already use. Screen readers, browser settings, OS-level accessibility. At best, it’s a surface-level signal that something is being done. At worst, it makes things harder. On the embedded script side, sure, some low-hanging issues can be cleaned up. But it doesn’t fix the real issue: teams were never taught how to design and build accessibly in the first place. If accessibility is something you “add later” with a tool, you stay ignorant upstream. Semantic HTML, keyboard flow, focus management, structure. That’s where accessibility actually lives. Most governments don’t have an accessibility problem. They have a fragmentation problem that creates accessibility problems. ⚠️ Today, remediation often looks like this: • Page‑by‑page fixes • Department‑by‑department reviews • Platform‑by‑platform audits That approach compounds complexity. Every time a service uses a different enrollment flow, login pattern, dashboard layout, or UI standard, accessibility drifts. Drift is what drives cost, exposure, and backlog.
