Personal Data Processing Notice

This Personal Data Processing Notice is provided by the Innovation Development Fund (hereinafter referred to as the 'Fund') to inform users of the Fund's website (hereinafter referred to as the 'User' and the 'Website', respectively), as well as individual entrepreneurs and representatives of counterparties (legal entities or individual entrepreneurs), acting as data subjects, about the data controller, the categories of personal data collected, the purposes of processing, the rights of data subjects, and the persons to whom personal data may be disclosed.

1. Data Controller

1.1 The controller of personal data is: Innovation Development Fund, 26 Otto Schmidt Street, Kyiv, 04107, Ukraine.

2. Personal Data Processed Through the Website

2.1 When using the Website, the Fund processes technical data collected through cookies, as described in the applicable Cookie Notice.

2.2 When submitting a citizen's inquiry through the electronic form available in the 'Contacts' subsection of the 'Fund Support Service' section or to the email address published on the Website, the Fund processes the following personal data:

  • surname, first name;
  • contact details (telephone number, email address, mailing address);
  • information contained in the inquiry.

3. Processing of Personal Data of Individual Entrepreneurs and Representatives of Counterparties

3.1 For the purpose of establishing contractual relationships with an individual entrepreneur or a representative of a counterparty (a legal entity or an individual entrepreneur), the Fund processes the following personal data:

  • full name (including patronymic, where applicable);
  • contact details (telephone number and email address);
  • information obtained through video surveillance within the Fund's premises (where video surveillance is in operation).

3.2 Where the User registers on the Website (including for participation in the Fund's programmes), the Fund processes the following personal data:

  • the selected role (e.g. Applicant, Expert, etc.);
  • first name and surname;
  • contact details (telephone number, email address, mailing address);
  • information provided in the registration form (depending on the selected role), as well as information required for participation in the selected Fund programme(s);
  • any additional information voluntarily provided by the User.

4. Purposes of Personal Data Processing

4.1 The Fund processes the personal data of Users submitting inquiries for the following purposes:

  • processing incoming inquiries addressed to the Fund;
  • protecting the Fund's rights in judicial or administrative proceedings.

4.2 The Fund processes the personal data of Users submitting applications for vacant positions for the following purposes:

  1. 4.2.1 conducting recruitment and selection procedures;
  2. 4.2.2 taking steps prior to entering into an employment contract;
  3. 4.2.3 ensuring security and controlling access to the Fund's premises;
  4. 4.2.4 protecting the Fund's rights in judicial or administrative proceedings.

4.3 The Fund processes the personal data of individual entrepreneurs and representatives of counterparties (legal entities or individual entrepreneurs) for the following purposes:

  1. 4.3.1 maintaining tax, accounting and archival records;
  2. 4.3.2 ensuring the operation of the Fund's anti-corruption compliance system;
  3. 4.3.3 concluding and performing contracts between the Fund and its counterparties (including suppliers, contractors and customers);
  4. 4.3.4 ensuring security and controlling access to the Fund's premises;
  5. 4.3.5 protecting the Fund's rights in judicial or administrative proceedings.

5. Disclosure of Personal Data to Third Parties

5.1 The Fund does not disclose Users' personal data to third parties except where such disclosure is required or permitted by applicable law.

6. Rights of Website Users, Individual Entrepreneurs and Representatives of Counterparties

In accordance with Article 8 of the Law of Ukraine 'On Personal Data Protection', data subjects have the right to:

  1. 6.1.1 be informed about the sources from which their personal data are collected, the location of such data, the purposes of processing, the identity of the controller or processor, and the conditions under which access to the data is granted;
  2. 6.1.2 access their personal data;
  3. 6.1.3 submit a reasoned request for the rectification or deletion of their personal data;
  4. 6.1.4 submit a reasoned objection to the processing of their personal data;
  5. 6.1.5 withdraw consent to the processing of their personal data, where processing is based on consent;
  6. 6.1.6 be informed about the mechanisms of automated processing of personal data;
  7. 6.1.7 be protected against decisions based solely on automated processing that produce legal consequences for them;
  8. 6.1.8 lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights or seek judicial protection of their rights.
